Buyer Terms and Conditions

Introduction

These Buyer Terms and Conditions (the Terms) govern the terms under which individuals (the Buyer or you) purchase goods through the online marketplace platform neta.market (Neta or the Platform).

The Platform is operated by SIA NetaDEV, registration number 40203665238, with its registered address at Smiltenes nov., Variņu pag., "Lejaslazdiņi", LV-4726 (the Platform Operator or we).

By placing an order on the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms, the General Terms of Use, and the Privacy Policy.

1. General Terms

1.1. Neta is an online marketplace that provides the technical infrastructure for transactions between Buyers and independent Sellers (makers).

1.2. The purchase agreement for goods is concluded directly between the Buyer and the Seller, not with Neta.

1.3. Neta is not the seller, manufacturer, supplier, or owner of the goods. All goods made available on the Platform are offered by independent Sellers.

1.4. Neta provides the technical environment for order placement, payment facilitation (where applicable), and delivery coordination.

1.5. For the purposes of these Terms, a Consumer means an individual purchasing goods for purposes outside their trade, business, craft, or profession.

2. Buyer Rights and Obligations

2.1. The Buyer shall have the right to:

  • purchase the goods offered on the Platform;
  • receive complete and accurate information regarding the goods before purchase;
  • receive information regarding the status of the order;
  • exercise the right of withdrawal in accordance with applicable law;
  • contact the Seller or Neta customer support with questions;
  • receive goods that conform to their description.

2.2. The Buyer undertakes to:

  • provide true, accurate, and complete information when placing an order;
  • provide the correct delivery address and contact information;
  • make payment in a timely manner using the selected payment method;
  • accept delivery at the specified delivery address;
  • use the Platform in good faith and comply with these Terms.

3. Purchase Methods

3.1. Orders may be placed on the Platform in the following two ways:

  • with a user account - by registering on the Platform and placing an order through the account;
  • without registration - by placing an order as a guest and providing only the information necessary to complete the order.

3.2. In either case, the Buyer must provide the following information in order to place an order:

  • email address (for communication and order status notifications);
  • delivery address;
  • contact information required for delivery.

3.3. A registered account provides the following benefits:

  • access to order history;
  • saved delivery information for future purchases;
  • faster order placement.

3.4. A Buyer with a registered account is responsible for maintaining the security of that account and for all actions taken through it.

3.5. All information regarding order status and changes thereto shall be sent to the email address provided by the Buyer. The Buyer shall receive email notifications regarding:

  • order confirmation;
  • receipt of payment;
  • progress in order preparation;
  • dispatch of shipment and tracking information;
  • other important order status updates.

3.6. The Buyer is responsible for providing a correct email address. Neta shall not be liable for notifications not received due to an incorrect email address.

4. Placing an Order

4.1. The Buyer places an order on the Platform by selecting a product, completing the required information, and confirming the order.

4.2. An order shall be deemed to have been placed:

  • for Stripe payments - upon successful processing of the payment;
  • for bank transfer payments - upon the Seller's confirmation of the order.

4.3. Upon placement of the order, the Buyer shall receive an email confirmation containing the order details.

4.4. Neta shall not be liable where the Seller refuses to fulfill the order for objective reasons (for example, where the product is no longer available). In such cases, any payment received shall be refunded to the Buyer.

4.5. The Buyer may cancel the order before the Seller has confirmed the order or commenced performance thereof.

5. Payments

5.1. Payments with Stripe Connect

5.1.1. Where the Seller offers payment through Stripe Connect, the Buyer may pay using:

  • payment card (Visa, Mastercard, etc.);
  • Apple Pay;
  • Google Pay;
  • other payment methods supported by Stripe.

5.1.2. In such cases:

  • the total amount includes the product price, delivery fee, and the applicable platform commission;
  • payment is processed immediately upon confirmation;
  • payment processing is provided by Stripe, Inc. acting as an independent payment service provider.

5.1.3. Stripe may process your payment data in accordance with its privacy policy: stripe.com/privacy

5.2. Payments without Stripe (bank transfer)

5.2.1. Where the Seller does not accept Stripe payments:

  • prepares an informational order summary or invoice;
  • payment is made directly between the Buyer and the Seller;
  • the Buyer shall transfer the payment to the bank account specified by the Seller.

5.2.2. In such cases, Neta:

  • does not process the payment;
  • does not store the Buyer's payment details;
  • is not involved in the transfer of funds between the parties.

6. Prices

6.1. Prices for goods are determined by the Sellers. Prices are displayed in euros (EUR) and include VAT where applicable.

6.2. The delivery fee shall be shown separately before the order is confirmed.

6.3. The total amount payable by the Buyer shall be clearly displayed before the order is confirmed and shall include:

  • the product price;
  • the delivery fee;
  • other applicable fees, if any.

6.4. Neta does not guarantee the accuracy of prices and shall not be liable for pricing errors made by Sellers.

7. Delivery

7.1. Neta does not itself provide the physical delivery of goods.

7.2. Delivery options:

  • Delivery organized by Neta - delivery is provided by independent courier services (delivery partners) with which Neta cooperates. The delivery fee is included in the total payment.
  • Delivery organized by the Seller - the Seller determines the delivery method, costs, and terms. Delivery terms shall be agreed between the Buyer and the Seller.

7.3. Delivery time depends on the Seller's production time and the delivery method. The estimated delivery time is indicated during checkout.

7.4. The Buyer must ensure that the goods can be received at the specified address. If delivery is not possible due to the Buyer's act or omission, an additional delivery fee may apply.

7.5. Neta shall not be liable for delivery delays or damage occurring during delivery where caused by delivery partners or the Seller.

8. Right of Withdrawal and Returns

8.1. The Buyer shall have the right to withdraw from the purchase within 14 days from receipt of the product, without stating any reason, in accordance with the Consumer Rights Protection Law of the Republic of Latvia.

8.2. The right of withdrawal does not apply to:

  • goods made according to the Buyer's individual order or clearly personalized goods;
  • goods that deteriorate quickly or have a limited shelf life;
  • sealed goods that have been opened after delivery and cannot be returned for hygiene reasons;
  • other exceptions provided by law.

8.3. In order to exercise the right of withdrawal, the Buyer must notify the Seller by submitting a clear statement of the decision to withdraw from the contract. The Buyer may use the sample withdrawal form below or any other unequivocal written statement.

8.4. When returning a product:

  • the product must be unused, in its original packaging, and in the same condition in which it was received;
  • the Buyer shall bear the return costs unless the product is damaged or does not conform to its description;
  • the refund shall be made within 14 days after the product has been received back.

8.5. The right of withdrawal shall be exercised directly against the Seller, as the Seller is the seller of the goods. Neta may provide technical support for communication, but shall not be responsible for the execution of the return process.

9. Warranty and Complaints

9.1. In accordance with consumer protection law, the Consumer is entitled to goods conforming to the contract for a period of 2 years from the date of receipt (statutory guarantee).

9.2. If the product does not conform to the contract (including where it is damaged or does not match the description), the Buyer may request:

  • replacement of the product with a conforming product;
  • repair of the product;
  • price reduction;
  • refund (if the remedies set out above are not possible).

9.3. Complaints regarding non-conforming goods must be submitted to the Seller within a reasonable time after the non-conformity is discovered. The Seller may request photographs of the product or other supporting evidence.

9.4. Neta may assist with communication between the Buyer and the Seller, but shall not be responsible for handling complaints or providing compensation.

9.5. If a dispute cannot be resolved with the Seller, the Buyer may apply to the Consumer Rights Protection Centre or to a court.

10. Liability

10.1. Neta shall not be liable for:

  • the quality of goods or their conformity with the description;
  • failure by the Seller to fulfill its obligations;
  • delivery delays or damage to goods;
  • disputes between the Buyer and the Seller;
  • temporary unavailability of the Platform due to maintenance or technical issues.

10.2. Neta's liability shall be limited to ensuring the technical operation of the Platform.

10.3. The Buyer shall be responsible for providing truthful information and using the Platform in good faith.

11. Dispute Resolution

11.1. Any dispute between the Buyer and the Seller shall first be addressed through mutual negotiations.

11.2. If no agreement can be reached, the Buyer, acting as a consumer, may apply to:

12.1. The Buyer's personal data shall be processed in accordance with Neta's Privacy Policy.

12.2. When placing an order, the Buyer's data may be disclosed to:

  • the Seller - to fulfill the order (name, address, contact information);
  • delivery partners - to provide delivery (name, address, phone number);
  • Stripe - for payment processing (if applicable).

12.3. The Buyer has the right to access, rectify, or request deletion of their data in accordance with the Privacy Policy.

13. Amendments to the Terms

13.1. Neta may amend these Terms at any time.

13.2. The current version of the Terms shall at all times be available on the Platform.

13.3. By continuing to use the Platform after amendments have been published, the Buyer acknowledges and accepts the updated Terms.

14. Final Provisions

14.1. These Terms shall be governed by and construed in accordance with the laws of the Republic of Latvia.

14.2. Consumer rights guaranteed under the laws of the Republic of Latvia and the European Union shall not be limited by these Terms.

14.3. The Latvian-language version of these Terms shall prevail and be legally binding.

14.4. If any provision of these Terms is held to be invalid or unenforceable, this shall not affect the validity or enforceability of the remaining provisions.
